By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of these Terms, you may not use our Service.
IMPORTANT NOTICE: These Terms contain an arbitration agreement and class action waiver in Section 15. By agreeing to these Terms, you agree to resolve disputes through binding arbitration and waive your right to participate in class actions.

Ajovia is a preventive health screening platform that provides:
- Comprehensive laboratory testing through Quest Diagnostics
- Medical imaging services (MRI scans) through partner imaging centers
- AI-powered health insights and recommendations
- Digital health dashboard and tracking tools
- Health reports and documentation
2.2 What We Don't Provide
Ajovia is NOT:
- A replacement for your primary care physician
- Emergency medical care
- Medical diagnosis or treatment
- Medical advice from licensed physicians
- A pharmacy or prescription service
- Health insurance

3. Eligibility and Account Registration

- You agree to follow all pre-test instructions (such as fasting)
4.2 Appointments
- You must schedule appointments at partner locations
- You are responsible for arriving on time
- Missed appointments may incur fees
- Rescheduling is subject to availability
4.3 Service Availability
- Services are not available in all states (currently unavailable in NY, NJ, RI)
- Some tests may have additional restrictions
- Availability may change without notice
5. Payment Terms
5.1 Pricing and Payment
- Prices are listed in US dollars
- Payment is due at time of purchase
- We accept credit cards, debit cards, HSA/FSA cards
- Payments are processed by our third-party processor, Stripe
5.2 Memberships and Subscriptions
- Annual memberships auto-renew unless cancelled
- You may cancel anytime before renewal
- Renewal charges occur on the anniversary date
- Price changes will be notified 30 days in advance
5.3 Refund Policy
- 30-Day Money Back Guarantee: Full refund if you haven't used any services
- After 30 days: No refunds for annual memberships
- Unused services: Pro-rated refunds may be available
- MRI scans: No refunds once scheduled

5.4 Insurance
- Ajovia services are generally not covered by insurance
- We do not submit claims to insurance companies
- You may submit receipts to your insurance for potential reimbursement
- HSA/FSA cards are accepted for eligible expenses

- Account termination

- Results are typically available within 3-7 business days
- Results are delivered through our secure platform
- You will receive notification when results are ready
- Some results may require additional processing time
7.2 Result Interpretation
- Results include reference ranges and explanations
- AI-powered insights are educational only
- Complex results may require physician consultation
- We do not provide medical diagnoses

While we strive for accuracy:
- Laboratory and imaging errors may occur

8. User Conduct and Restrictions

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AJERIS AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR:
- INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
- LOST PROFITS OR REVENUE
- LOSS OF DATA
- PERSONAL INJURY OR PROPERTY DAMAGE
- EMOTIONAL DISTRESS
12.2 Cap on Liability
OUR TOTAL LIABILITY FOR ANY CLAIMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

These limitations may not apply where prohibited by law, including:

We may terminate or suspend your account for:
- Violation of these Terms
- Fraudulent or illegal activity
- Non-payment

- Unused services may be forfeited
- Your health records will be retained as required by law
- Certain provisions of these Terms survive termination
15. Dispute Resolution
15.1 Arbitration Agreement
YOU AND AJERIS AGREE TO RESOLVE ALL DISPUTES THROUGH BINDING ARBITRATION INSTEAD OF COURT, EXCEPT FOR CERTAIN SMALL CLAIMS.

- Arbitration will occur in Atlanta, Georgia
- Federal Arbitration Act governs
- Arbitrator's decision is final
15.2 Class Action Waiver
YOU WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTIONS, CLASS ARBITRATIONS, OR REPRESENTATIVE ACTIONS. DISPUTES MUST BE BROUGHT INDIVIDUALLY.

You may opt out of arbitration within 30 days of accepting these Terms by sending written notice to:

If any provision is found unenforceable, the remaining provisions will continue in effect.
16.4 Waiver
Our failure to enforce any right or provision is not a waiver of that right or provision.
16.5 Assignment
You may not assign these Terms without our consent. We may assign these Terms without restriction.
